Vicarious Liability for the Late Filing of the Application for Declaring the Debtor Bankrupt

This study will examine the basis for bringing to vicarious liability for the late filing of the application for declaring the debtor bankrupt. At the beginning of the work will identify the main problems of this institution, and then will be made analysis and comparison of vicarious and tort liability, will be a comparison of vicarious liability to foreign analogues. After that it will be revealed differences between the test ground for bringing to vicarious liability and the basis referred to in paragraph 4 of Article 10 of the Bankruptcy Act. Next is the problem of determining the range of persons subject to vicarious liability for the studied base to attract vicarious liability. Then it will be studied the question of determining the date of commencement of the period for submission of the application by the debtor for their own bankruptcy. At each stage of the study will identify the problem areas of existing law and practice in the framework of research, and suggests ways to deal with such issues.
