Improvement of Legal Regulation of Lease Agreement in Russian Federation

The relevance of the research is due to the urgent need to reform domestic legislation of leasing, since the practice of its application does not meet the purposes for which such regulation was originally introduced. In terms of existing problems, the following should be highlighted: the question of the status of leasing legal relations in the Russian law of obligations, the issue of the location of certain types of leasing in the system of contractual regulation, and the problem of consumer leasing as a contract contrasted with classical financial leasing. In the course of the research carried out by the author, the dialectical method of investigation, the comparative legal method of research, methods of analysis, synthesis were used, which allowed to come to the results indicated in the work. Thus, the effectiveness of consumer leasing in civil turnover is shown in the work, as well as the necessity to include operational leasing into the system of leasing legal relationships, as well as the essence of leasing as an obligation, rather than the aggregate of individual contracts. The results of the study have broadened the notion of operational leasing, consumer leasing, and can be implemented in lawmaking, as well as the activities of professional leasing companies.
