The subject of research in this paper is the relationship between the concepts of "abuse of right" and "unfair competition" in the sphere of the exclusive right to a trademark. This topic is very relevant for today due to the active development of intellectual property rights in the Russian Federation. Also, special attention should be paid to the trademark not only as an intangible asset of a business entity, but as an effective way to protect its rights and legitimate interests. The purpose of this work is to reveal the essence of the concepts of "abuse of right" and "unfair competition" in the sphere of the exclusive right to a trademark, to determine the correlation of the terms in question through analysis of legislation and jurisprudence, and to identify key approaches to the topic under study in law theory.
