The Principle of Good Faith in the Russian Civil Law

Basic provisions of the Roman right about conscientiousness have remained till our time and have passed into modern civil law, including: the conscientious purchaser, conscientious possession, the dobroksovestny party in the contract, etc. Such stability of legal designs of the Roman right confirms their undoubted value for science of civil law. In general the majority of the regulations on conscientiousness drafted by the Roman right have found the fixing and development in modern laws and orders of the romano-German legal family. In practice the majority of the problems connected with the principle of conscientiousness rests against lack of legal and general disclosure of this concept by means of legislative fixing. Permission of the matter requires systematization of knowledge of the principle of conscientiousness, and also more concrete definitions of practical value of this category in civil legal relationship.
