The Voluntary Refusal of Crime: Theoretical and Practical Problems

Graduation qualification research is devoted to the problems of theory and practice of applying the institute of voluntary refusal of crime in the Russian legal reality. The work is structured with the introduction, two chapters, conclusion and list of used sources. The introduction gives a brief of historical reference about the researched institute, the relevance of the topic is established, the goals and objectives of the research are set, and the theoretical and practical basis of the research is consolidated. The first chapter includes three paragraphs which illustrate the concept, signs and motives of voluntary refusal; characteristic features of voluntary refusal depending on the stage of commission of the crime; a comparative analysis of voluntary refusal in Russian and foreign legislation. The second chapter also consists of three paragraphs and is devoted to voluntary renunciation of crime as the basis for exemption from criminal liability. It contains the following points: comparative characteristics of voluntary refusal and active repentance; peculiarities of voluntary refusal of accomplices and analysis of judicial practice on the basis of the sentence of the Leningrad Regional Court of 29.10.2012 in case No. 2-50 / 2012. In conclusion, conclusions are drawn on the topic under study, as well as practical suggestions for improving the current criminal legislation in the field of the institute studied.
