Deprivation of Parental Rights: Some Problems of Legal Regulation and Law Enforcement Practice

The paper deals with the problem of the fullest respect for the rights of the child in the deprivation of parental rights, which is often violated in judicial practice. The purpose of the research is to investigate the problems arising in the implementation of the institution of deprivation of parental rights. Methodologically, the research is performed within the framework of family law of Russia by using comparative, analytical, logical methods and comparative legal method, which helps to reveal the legal significance of this problem. The study formulated the idea of the need to establish the order of application of measures of family legal responsibility, the legal nature of the acts signed by the parent before the deprivation of parental rights, the need to provide social support to parents deprived of parental rights and their children together, the incorporation in The Family Code of the Russian Federation of the following terms: deprivation of parental rights, cruel treatment, mental violence.
