Protection of Copyright and Related Rights in Music

This paper is devoted to the study of copyright and related rights in music. This research provides legal characteristics of objects of copyright and related rights, namely the concept and legal nature of a music work, music performance and a phonogram, as well as individual objects of copyright and related rights that are used in the music sphere. Also, legal features of the protection of objects of copyright and related rights in the music sphere were determined. In addition, an analysis of the activities of organizations engaged in the management of rights on a collective basis was carried out. The conclusions presented in the paper are based on the study of special literature, regulations and materials of law enforcement practice. According to the results of a comprehensive study, it is concluded that despite the imperfection in the application of criminal and administrative responsibility, Russian legislation has a fairly wide range of ways to protect intellectual property rights. In addition, it can be noted that civil-law methods of protection of copyright and related rights in the music sphere are the most effective at the moment. In addition, to improve the legislation and law enforcement practice, it is proposed to amend article 1244 of the Civil Code of the Russian Federation.
