Ways to Protect the Rights of Entrepreneurs in the Implementation of State Control and Municipal Control and Their Effectiveness

The work is devoted to the analysis of law enforcement practice, scientific literature and legislation on the implementation of ways to protect the rights of entrepreneurs in the implementation of state control (supervision), municipal control. The work explains the existence of problems with the subject and subjects and appeals, which allows to conclude that the legislation is imperfect. The lack of a legal definition of the result of a check complicates enforcement. As a result, the courts of general jurisdiction and arbitration courts do not have a unanimous opinion on the subject of appeal, thereby violating the principle of equality, since given the same requirements of the applicant, they can be satisfied in one court and rejected by another court. It is concluded that the main feature of the subject of appeal is a violation of rights and legitimate interests. As a result, the low effectiveness of the methods of protection is indicated, which is associated with an insufficient settlement of state control. This work can be used as a legal opinion.
