Legal Nature of In-game Items

This paper explores the legal nature of in-game items and the possible legal qualification of transactions carried out with such items. Attention is paid to the content of End-User License Agreements, the unequal position of game developers and users, and the deliberate restriction of players' rights as a result of the acceptance of the developer’s offer. The exchange of in-game items on third-party trading platforms and the risks associated with it are considered. This paper also examines the coming into force of the Law “On digital rights” and the application of its provisions to in-game items.
