The Problems of Criminal Resposibility for the Provision of Services Which Do not Meet the Safety Requirements

Within the framework of this study, a crime established by Article 238 of the Criminal Code of the Russian Federation is considered, namely, such an act as the provision of services that do not meet safety requirements. The subject of the research is cosmetology services provided by persons who are not entitled to carry out such activities. The purpose of this study was to analyze the features and problems that arise when qualifying an act under Article 238 of the Criminal Code of the Russian Federation. The relevance of the topic is expressed in the fact that cosmetology services began to be provided not so long ago, but due to the actively developing popularity of such services, this area began to attract unscrupulous persons who harm the health and lives of people. The work will conduct a criminal-legal analysis of the crime provided for by Article 238 of the Criminal Code of the Russian Federation. Also, the study will delimit offenses adjacent to Article 238 of the Criminal Code of the Russian Federation, namely: Articles 109, 118 and 171 of the Criminal Code of the Russian Federation. It will also analyze the features of delimiting criminal responsibility from administrative responsibility for similar actions.
