Constitutional Guarantees of Freedom of Speech, Press and Information

The purpose of the final qualification work is to reveal the main problems of the implementation of the constitutional rights of freedom of speech, press and information. The object of the study is the social relations that develop in the process of formation, search, distribution and consumption of mass media, as well as their consolidation at the legislative level and reflection in law enforcement practice. The relevance of the topic is related to the lack of balance between freedom and restrictions imposed by the authorities for the purpose of state protection of constitutional rights. Special emphasis is placed on the regulation of such special subjects of the rights of freedom of speech, press and information, as the media and blog owners. The author examines the guarantees and mechanisms for protecting the rights of freedom of the media, as well as analyzes the practice of the highest courts of the Russian Federation and the European Court of Human Rights. Based on this analysis, the problems that exist at the moment were identified. The author comes to conclusions about the reform of the legislation of the Russian Federation and the need to form a uniform judicial practice.
