Nationality of a Foreign Investor: Specifics of Application of the Doctrine of Piercing the Corporate Veil in Private International Law

The study is devoted to the legal regulation of the nationality of a foreign investor in private international law, as well as the doctrine of piercing the corporate veil as a way to combat unfair foreign investors. The purpose of this work is to analyze the concept of treaty shopping in investment law and determine the criteria for using the doctrine of piercing the corporate veil in international arbitration. To achieve this goal, the following tasks were solved: To achieve this goal, the following tasks were set: Defined the basic concepts of foreign investment and the nationality of a foreign investor; identified the main approaches to determining the nationality of a foreign investor; analyzed the concept of treaty shopping; the practice of applying the doctrine of removing the corporate veil in international investment disputes has been studied; the practice of applying the doctrine of removing the corporate veil in the USA and Great Britain is highlighted; considered the possibility and prospects of applying the doctrine of removing the corporate veil in the Russian Federation
