Ban of Harmful Behavior Content: Legal Aspects

The dissertation explores the problem of blocking information about dangerous behavior. The work has an interdisciplinary focus as it involves both psychology and jurisprudence. The object of the study was the social relations associated with the creation and dissemination of information on dangerous behavior on the Internet, as well as methods to combat the dissemination of such information. The subject matter of the research was scientific research of the system of ideas concerning the information on dangerous behavior on the Internet and methods to combat the dissemination of such information, Russian and foreign laws and regulations, decisions of domestic law enforcement agencies. The author focuses on the study of two categories of information on harmful behavior which, from the point of view of legislation, pose a threat to the well-being and development of children. The author has established the following as the aims of the study: - establish reasons for restricting access to certain types of information on dangerous behavior; - nvestigate the effectiveness of information blocking as a method of combating information dissemination. The author has set the following as objectives: - describe the frequency of use of the Internet by minors; - describe the concept of “information about risky behavior”; - examine the factors that encourage young people to interact with information about risky behavior; - examine the legislation that applies to restrict the dissemination of information on the Internet. The study begins with an examination of the psychological aspects of the influence of information on human behavior. The author explores the characteristics of the concept of “information about dangerous behavior”, citing factors that encourage minors to interact with such information. The author then proceeds to the elucidation of the grounds for restricting access to certain types of information. The author identifies information about suicidal behavior and information about non-traditional relationships as the main categories. The author concludes that information about risky behavior is a rather broad concept, and scientific papers also use a different terminology, namely "destructive information", i.e. information that is destructive to the health and well-being of minors. Problems in restricting access to information about risky behavior are cited as follows: (1) overly formal adherence to established norms in ascertaining the substance and content of the information, (2) extrajudicial immediate blocking of access to an entire website with the possibility of challenging it in court within 3 months, and (3) inability to correct negative indicators, despite the opposition to the spread of information on dangerous behavior that has been ongoing since 2012, the number of tragic cases of dangerous behavior continues to increase. The study managed to establish that a set of tools should be used to qualitatively counteract the growth of information on dangerous behavior: modern technologies, improvement of education, training of teachers for early detection of suicidal attitudes in children.
