The Institute of Preemptive Rights in Russian Law: Theory and Practice of Application

This final qualification work is devoted to the issue of pre-emptive rights from the point of view of their comparative legal analysis. Many works devoted to the study of pre-emptive rights do not justifiably avoid the issue of the existence of pre-emptive rights arising from a contract. The purpose of this paper is to attempt to systematise pre-emptive rights, to analyse the place of contractual pre-emptive rights in the system of civil law, as well as the peculiarities of their establishment. A new type of classification of pre-emptive rights is proposed, practical recommendations for unnamed contractual pre-emptive rights are developed, and the methods of their protection are assessed.
