Legal Regulation of the Creditors Meeting in Bankruptcy Cases

The creditors meeting plays a central role in bankruptcy cases, despite this, in the scientific literature, questions about its legal nature and legal regulation remain without due attention. Our study analyzed the legal nature of the meeting of creditors and concluded that the meeting of creditors can be both a management body of the juridical person and exclusively a body of the community of creditors. Based on these conclusions, an analysis of purposes competence and procedure for preparing, convening and holding a meeting of creditors was carried out. The results of which emphasized the need to distinguish between the creditors meeting, which acts as the management body of the juridical person, and the body of the community of creditors.
