Features of Legal Regulation of the Relations Arising During the Creation, Development and Operation of Public Information Systems

Information systems in the Russian Federation form the basis for digital public administration, which is implemented at both the federal and municipal levels. Public authorities and local self-governing bodies create and operate information systems to meet almost every possible need of citizens. The process of creating a unified system of government agencies has reasonably raised the question about the continued existence of state and municipal information systems, and the need for a new legal term "public information system". In order to determine the meaning of the legal category of "public information systems" and to identify the distinctive features of public relations in which such systems act as objects of legal regulation, it is necessary to carry out tasks related to assessing the constitutive features of these systems, analyzing the legal status of organizations that implement their technical functionality, defining the legal regime for information posted and assessing the adequacy of regulatory control over certain aspects of their lifecycle. In the study conducted using general scientific and special methods of cognition, conclusions were formulated regarding the need to consider the source of funding for expenses as a key criterion for identifying public information systems. The study also revealed the asymmetric nature of the distribution of rights and obligations between participants in the relevant legal relations, as well as the existence of a specific regime for socially significant information. Additionally, the study identified the lack of regulatory consistency in the life cycle of information systems, which has led to the emergence of legacy systems. Furthermore, a change in approach to the creation, development, and operation of public information systems was identified in connection with the emergence of the Single Digital Platform "Gostech".
