General Average and Mediation in Private Maritime Law

The study is aimed at analyzing effective measures for optimizing the process of distributing losses in the event of a general average declaration and dispute resolution. Based on the analysis of the mediation institution and the general average, the paper identifies opportunities for integrating mediation mechanisms to resolve conflicts among participants in the transportation process. The goal of the study is to analyze the norms of Russian and foreign legislation, as well as international treaties, regulating the process of maritime trade in the event of accidents. The paper also outlines tasks, including identifying sources of regulation for mediation and general average, analyzing factors influencing the mediability of disputes, and identifying prospects for using mediation in loss distribution.
