Specific features of recovery and distribution of expenses in a bankruptcy case

The number of bankruptcy cases is increasing every year, leading to a rise in the number of individuals involved and their costs associated with participating in the proceedings. Despite extensive research by the Institute of Judicial Expenses, the issue of bankruptcy proceedings is still in its early stages of development. The current regulation regarding the recovery and allocation of judicial expenses in bankruptcy cases does not meet the needs of civil turnover. Since bankruptcy legislation concerning judicial expenses is still in the process of formation and development, judicial lawmaking predominates in this matter. This, in turn, contributes to the formation of diverse positions and leads to problems in legal application. This work is dedicated to the peculiarities of recovering and allocating expenses in bankruptcy proceedings. The aim of this study is to identify trends in contemporary judicial practice regarding the recovery and allocation of judicial expenses within bankruptcy cases, their correlation with the general principles of the Russian Civil Procedure Code concerning judicial expenses, and the Bankruptcy Law, as well as to form a comprehensive understanding of recovering and allocating judicial expenses in bankruptcy proceedings. The author of this research has identified the specific features of bankruptcy cases that affect the recovery of judicial expenses, determined the range of subjects involved in the process of allocating judicial expenses, and explored possible methods of determining the priority of recovering judicial expenses in bankruptcy proceedings.
