Traditional family values as the basis for the realization of reproductive rights in the Russian Federation: the search for balance of interests

In the graduation thesis the author analyzes the correlation between traditional family values and human reproductive rights. The goal is to find a balance between these values, which represent public interests, and the above mentioned rights, the core of which is the right to reproductive self-determination. The study examined the development and regulation of family relations in order to form an idea of the origin and content of traditional family values. The author analyzed national legislation and decisions of the Constitutional Court of the Russian Federation to understand the nature of these values, to determine their role in the system of constitutional values and their significance for the realization of human rights. A separate part of the work is devoted to the problem of values research in the legal regulation and judicial practice of the European Union countries, as well as the ECHR. The paper defines the concept and types of human reproductive rights, their essence and main characteristics. It identifies three approaches used to regulate reproductive rights in the light of traditional family values - incentive, gap and restrictive. The author evaluated the restrictions of the most important reproductive rights for compliance with the principle of proportionality. According to the author, despite the contradiction between traditional family values and human reproductive rights, the harmonious coexistence of these values and rights is possible if the legislative regulation is changed in the direction of providing greater discretion to the subjects realizing these rights.
