Greenmail as a Form of Rights Abuse in Corporate Legal Relationships

This master's thesis is devoted to the study of greenmail as a form of rights abuse in corporate legal relationships. The author has studied the institution of abuse of law, summarized doctrinal approaches to the definition of the “greenmail” concept, identified gaps in legislation, analyzed current judicial practice and identified trends on the described issue. The result of the study is recommendations to reduce the risk of greenmail against the corporation and neutralize its negative consequences, as well as proposals for improving the regulatory framework in terms of regulating the phenomenon under study.
