E-Commerce and Freedom of Entrepreneurship in India: An International Legal Perspective

Student: Pankaj Gautam

Supervisor: Daria Boklan

Faculty: Faculty of Law

Educational Programme: Law of International Trade and Dispute Resolution (Master)

Final Grade: 8

Year of Graduation: 2024

This master's thesis explores the obstacles faced by entrepreneurs navigating the legal intersection between Indian domestic law and foreign law as it relates to e-commerce regulation. Important pieces of legislation including the Consumer Protection Act, the Information Technology Act, and national e-commerce policies, interact with global frameworks that control competition, intellectual property, and cross-border data flows. Entrepreneurs have to deal with complicated tax laws, customs procedures, environmental compliance requirements, and a wide range of customer preferences. In order to support e-commerce growth and entrepreneurship in India's changing digital ecosystem, potential improvements include strong data protection, intellectual property safeguards, expedited dispute resolution, and harmonized international trade norms.
