Legal methods for protecting the rights and legitimate interests of foreign investors during expropriation of foreign investments in China

The purpose of the research is to study the legal aspects of protecting the rights and legitimate interests of foreign investors during the expropriation of foreign investments in China. The final qualifying work consists of: an introduction, three chapters divided into paragraphs, a conclusion and a bibliography. The introduction substantiates the relevance of the research topic, the purpose and objectives of the study. The first chapter “Sources of regulation of foreign investment and the regime of activity of a foreign investor in China” examines international treaties and national legislation of China on foreign investment, as well as ways of creating and operating organizations with foreign investment in China. The second chapter “The conceptual and categorical apparatus of modern investment law in China. Types of expropriation” is devoted to the research of the concepts of foreign investment, foreign direct investment, foreign investor, investment activity, as well as the definition of the concept of expropriation and its types. The third chapter “Modern methods of protecting the rights of foreign investors in the event of expropriation of their property in China. Analysis of the judicial and arbitration practice of China in the field of expropriation of foreign investments” contains the practice of resolving disputes related to the expropriation of foreign investments, methods of insuring the risk of expropriation and a mechanism for compensation in case of expropriation. In conclusion, the main findings obtained as a result of the study are presented.
