The Legal Nature of Ads of Legal Entities on Classifieds: Advertising or Offer?

Currently, there is a development of the economic sphere of society, as well as information technology. This circumstance is a natural consequence of the growing importance of online services that allow consumers to freely purchase not only goods, but also use services, purchase not only real estate, but also cars, and get a job without leaving home. Classifieds is an ad placement service that contains thematically grouped ads depending on the content of such ads, providing access to the market to small players and allowing them to offer their goods and services, create a reputation. In the Russian Federation, such classifieds are known as Auto.ru ; HeadHunter; SuperJob; Avito; Domclick; Salary.<url>; Pros; Work.<url>; Cyanogen; Yula; Yandex Real Estate; Yandex Services. The relevant provisions of the legislation regulating the activities of classifieds include the provisions of Federal Law No. 149-FZ dated 07/27/2006 "On Information, Information Technologies and Information Protection" (hereinafter – the Federal Law "On Information"), namely Article 10.7 obligations of the owner of the ad placement service. At the same time, it does not specify what an announcement is and its concept is fixed. And the legislation on advertising does not contain special rules on the concept of ads. As a result, the question of the qualification and definition of the legal nature of ads becomes quite obvious. The concept of "classifieds", its types and features of work in Russia are formulated, the analysis of the regulatory framework governing the activities of classifieds is carried out, the concept and content of ads are defined, judicial and antimonopoly practice on disputes related to ads is studied, proposals for changing legislation in the field of ad placement are formulated.
