Legal Characteristics of NFT Marketplaces

The purpose of this work is to conduct a comprehensive theoretical, legal, technical and economic analysis of transactions carried out on NFT marketplaces, the public legal status of NFT marketplaces, as well as the very object of purchase and sale on these marketplaces, namely NFT. The Introduction substantiates the relevance of the chosen topic, defines the goals, objectives of the research, novelty and practical significance, as well as the results of testing the theoretical research of the work. Chapter 1 analyzes: the legal status of a decentralized application as a smart contract. Chapter 2 discusses: the legal status of cryptocurrencies in the Russian Federation, as well as the general and special features of NFTs in comparison with cryptocurrencies. Chapter 3 examines: the public legal obligations of the owner of the NFT marketplace, as well as the legal relations that arise when buying and selling NFTs within the NFT marketplace. The WRC analyzes judicial practice, the doctrine of Russian law on the legal status of smart contracts, cryptocurrency, NFTs, and formulates proposals for improving the current legislation. The Conclusion draws conclusions.
