The Legal Regime of the AI-Generated Software

The subject of this work is “generative software” - a computer program that is generated by artificial intelligence at the user’s request. Being, on the one hand, based on its objective form close to traditional software, generative software has a radically different legal regime, as it is not created by a person upon which the intellectual property law is built. The key functional features of the relevant artificial intelligence models are analyzed; a comparative analysis of “traditional” and generative software was conducted; the key characteristics of the legal regime of the latter are given both in general and in relation, in particular, to various types of software. In conclusion, a dualistic model of the legal regime of gen-AI was proposed, taking into account the balance of interests of the persons involved.
