Improvement of the Measures of State Support for Online Cinema Markets in the Context of Sanctions Restrictions

The socio-economic relevance of this study is relevant due to the growing interest in exploring the role of audiovisual services as part of the film production and creative industries in particular countries. The economic significance of the study for the Russian market is determined by the lack of conditions for fair competition between legal and pirate audiovisual services due to the external restrictive measures of 2022. In terms of legislative approach, the paper focuses on identifying and solving the problem of the imbalance in public and private rights between legal audiovisual services and foreign rights holders, which also contributes to the aggravation of the antitrust problem. Due to the fact that there are very few studies devoted to mechanisms of the governmental solution in the designated market, the purpose of this paper is to develop recommendations on State regulation of conditions of fair competition in the market of audiovisual services by identifying key problems with the help of consumer choice model and competitive market model. In order to build the first model, an online questionnaire survey was conducted by which it was possible to collect the user's assessment of eight previously identified criteria of consumer choice. The second model was built on the basis of the Herfindahl-Hirschman index and allowed us to identify the risks of monopolistic competition in the analyzed market. Thus, the identified market problems involve imperfect legal framework, monopolistic tendencies, and lack of supportive measures in the industry, which are proposed to be addressed through conceptual legislative projects in the field of compulsory licensing, antitrust regulation, and tax policy.
