Problems of Legal Regulation of Personal Data Processing by Pharmaceutical Companies in Russia and Abroad

Within the framework of this study, an attempt is made to identify the most problematic issues of personal data processing, as well as to propose possible solutions to the identified problems. The first chapter is devoted to the analysis of the subject and method of regulation of personal data processing, sources of regulation, as well as existing regulatory issues relevant to most personal data operators. In the second chapter, using the example of clinical trials and pharmacovigilance, the legal issues of personal data processing related directly to pharmaceutical companies are considered. The greatest attention is paid to the study of the sufficiency of the legal grounds provided for by Russian legislation for the processing of personal data of a special category. The paper suggests ways to solve these problems, including taking into account foreign experience.
