The use of a preventive measure in the form of detention in the Russian criminal process: theory and practice.

Research topic: Application of a preventive measure in the form of detention in Russian criminal proceedings: theory and practice. The relevance of the topic is due to constant changes in legislation and problems of its practical application. This study consists of an introduction, three chapters containing six paragraphs, a conclusion and a bibliography. The purpose of the research work is a comprehensive analysis of the institution of detention, legal relations arising in the process of its application, as well as the development of recommendations for improving the current legislation. Research objectives: 1) Analyze the history of the development and emergence of a preventive measure in the form of detention. 2) Explore the meaning and concept of detention. 3) Analyze the legal grounds and circumstances that are taken into account when applying detention. 4) Explore the possibility of changing or canceling detention for another, milder measure of restraint. 5) Study the existing problems of law enforcement practice and find ways to solve them. 6) Make proposals aimed at liberalizing this preventive measure in Russian criminal proceedings. As a result of the study, it was possible to establish that detention differs from other preventive measures and has its own characteristics of application and normative consolidation, regulatory legal acts contain deficiencies in their consolidation, there are no legal definitions of the most important concepts, there are problems that arise in the process of choosing a preventive measure in the form of imprisonment into custody, which is confirmed by the analysis of court decisions of courts at different levels.
