Civil Law Protection of Software in Russia

The work analyzes software as an object of civil legal relations. The constituent elements of software and the correlation between the concepts of "software" and "computer program" were identified. The peculiarities of different forms of legal protection of software: copyright, patent and as know-how; their disadvantages and advantages are highlighted. It is revealed that in Russia the complex legal protection of software is actually realized. The question of the legal status of artificial intelligence (AI) technology is considered separately. The main legal approaches to AI and to the legal protection of intellectual property objects (including software), which are created with the use of AI, are highlighted It is concluded that it is necessary to extend to such objects the legal regime of protection of related rights.
