Judicial protection of business reputation in the arbitration process

This scientific work is devoted to the study of issues of judicial protection of business reputation in the arbitration process. As part of the study of this topic, business reputation was considered as an object of civil rights, namely, its concept was defined, the essence of the institute of business reputation in Russian law was determined, the place of business reputation in the system of objects of civil rights was revealed, the ratio of the concepts of "business reputation", "honor", "dignity" and "good name" was determined, the content of the right to judicial protection of business reputation. In addition, the author examines the features of judicial protection of business reputation in the Russian arbitration process, as well as analyzes foreign experience in legal support of judicial protection of business reputation. Based on the results of the study, a number of conclusions have been drawn that have elements of scientific novelty. The author consistently proves that the development of the theoretical foundations of business reputation in the domestic civil rights system with the elaboration of the most problematic issues of its judicial protection, for example, issues of evidence related to the establishment of the boundary between freedom of speech and the right to protect business reputation, the specifics of protecting reputational harm of legal entities, will improve the practice of law enforcement in this area and ensure a high the level of protection of the right to business reputation.
