Criminal procedural guarantees of the rights of owners and legal possessors of property subject to seizure.

The purpose of the graduate qualification work is to analyze the criminal procedural guarantees of the rights of owners and legal owners of the property on which the arrest is imposed. When arresting property in the implementation of the investigation of criminal acts, there are currently observed theoretical and practical problems that jeopardize the rights and legitimate interests of property owners. This is particularly dangerous in view of the fact that the citizens in question have not been found guilty by a court of law of committing a crime, the proceedings against them are only under way and, in this connection, it is inadmissible to cause damage to their interests. In particular, there are problems associated with the seizure of property of persons in bankruptcy proceedings. The existence of these problems potentially leads to violation of the rights of an extremely wide range of creditors. Therefore, it is relevant to analyze the criminal procedural guarantees of the rights of owners and legal owners of the property, on which the arrest is imposed.
