Division of Marital Property: Theoretical and Practical Issues

This final qualifying work is aimed at researching the legal regulation of the division of marital property. The relevance of the study is due to the fact that over the past few years a large number of marriages have broken up. While the presence of gaps and conflicts in family law leads to contradictory judicial practice. Having decided to terminate the marriage, the former spouses will have to share their jointly acquired property. This can be done in a pre-trial and judicial manner. This work consists of 3 chapters, the first one outlines the concept and legal regulation of common joint property of spouses. The second is the procedure for dividing the common property of the spouses in a non-judicial and judicial manner. Finally, the specifics of the division of certain types of marital property. Having considered these provisions, legislative changes were proposed, as well as ways of interpreting certain norms, which, when adopted or used in practice, will make the division of property of spouses at the dissolution of marriage consistent and predictable.
