Agreements in Family Relations

The relevance of the study is due to the fact that in the context of the transformation of intra-family relations, the issue of their settlement through various kinds of agreements is being actualized, allowing to exclude proceedings in court. The special importance of family agreements lies in the fact that their conclusion allows the parties to independently resolve disputes while maintaining a personal and trusting relationship and maintaining a balance of interests of all parties to such agreements. The study revealed a number of urgent problems in the field of legal aspects of agreements in family relations: the absence in the norms of the IC of the Russian Federation of a clear, specific indication of the form of concluding an agreement on determining the place of residence of children; the lack of regulation regarding the obligation of the parties to include in it the conditions of occurrence and the amount of responsibility of the payer when concluding an agreement on the payment of alimony; the lack of specification of criteria for such grounds for invalidation of a marriage contract as an "extremely unfavorable situation", which leads to a lack of uniformity of law enforcement. In order to solve the problems identified in the study, the author formulated a number of proposals for leveling the identified legislative gaps and omissions. The author believes that the formulated proposals can contribute to improving the effectiveness of the independent settlement of family relations, as well as the enforceability of the terms of the agreements concluded.
