Supply Contract According to Russian Civil Law

The relevance of the research topic is predetermined by the fact that modern business conditions require detailed regulation of contractual relations, which is caused by the complexity of relations between subjects of civil law. Insufficient regulation of various aspects when agreeing on the terms of a supply agreement increases risks for the entrepreneur, both reputational and financial. The study made it possible to identify current problems associated with the conclusion and execution of a supply contract. Among them: the absence in the legislation of a specific list of essential conditions, as well as the form for concluding a supply agreement; the presence of evaluation categories, such as “reasonable time”, “immediate notification”, which negatively affect the practice of proper execution of the contract; lack of specification regarding the period of ensuring the safety of the goods during their responsible storage; insufficient regulation of signs indicating significant violations of the terms of the supply contract, which, in turn, serve as the basis for unilateral refusal to fulfill the contract. The identified problems adversely affect civil law turnover. In this connection, the author has formulated proposals for their elimination, which can contribute to the uniformity of law enforcement practice, increase the efficiency of civil turnover, as an integral component of business activity in modern conditions of civil legal relations, where the supply agreement plays an important role in ensuring contractual obligations between subjects of civil turnover .
