Limit Parameters of Development in the Zoning Ordinace: Assessment of the State of Development Regulation in Cities

The research work is aimed at studying the current limit parameters of permitted construction in urban planning regulation documents and how they actually determine the configuration of land plots, dimensions and location of the object within the boundaries of the land plot in Russian cities. In the research the subject of study are urban planning regulations and requirements of the AGO established in the urban planning regulations of the PZZ Since these legal zoning instruments are the means of regulation that set the design and character of urban development. Zoning documents have accumulated a variety of experience and methods of regulation. The reviewed experience of cities in Europe and the United States showed the difference in the structure of the urban planning system and the structure of urban planning regulations. But despite the different approaches, the main goal of urban planning regulation is the sustainable development of modern cities. Zoning in Russia is a young instrument compared to other countries. Experts note the incompleteness of the processes established in urban planning zoning in Russia. In parallel with the development of regulations, new documents regulating the urban environment are emerging, one of which is the AGO. Thereby pushing back the potential of the PZZ regulations to regulate facade and street frontage parameters. The effectiveness of an urban planning regulation lies in the filling of multidirectional sets of parameters that are consistent with each other (land plot, development envelope, facades, street frontage, etc.). In this case, it is important that the value of the parameters were developed taking into account the characteristics of the urban environment of the territorial zone. The more groups of regulation, the more certain is the result of construction changes on the land plot. Studying the theoretical basis of urban regulation, the main principles of law and ideas about the perfect form of urban planning regulation were identified, which should be met by modern documents to achieve sustainable development, namely the certainty of established values and predictability of construction changes. The research resulted in the developed methodology for assessing the actual condition in ten large Russian cities with a population of more than one million people. The assessment criteria are developed based on the principles of law. The obtained result of the assessment according to the proposed methodology helps to highlight the incorrectness of the established values of limit parameters, inconsistency with the actual typology of development, to understand the priorities of regulation today, and what needs to be improved or corrected in urban planning regulations to achieve the best result in the future.
