Educational Programme: Church, Society and State. Legal Regulation of Religious Organisations (Master)

Year of Graduation: 2024

Graduation qualification work explores the process of legal regulation of the granting of land to religious organizations. This work is located at the junction of various research areas of legal sciences, characterized by a complex character, covering the norms of various branches of law, both material and procedural. The aggravation of external threats and destructive ideological influence on society has led to the; state to support the main religious currents within the framework of public policies aimed at preserving and strengthening traditional spiritual values. One of the measures of state support is the donation of land to religious organizations. Despite the existence of laws, the mechanism for granting land to religious organizations proves to be quite complex in practice, as evidenced by the case law documents, the analysis of which shows, on the one hand, the existence of abusive refusals to grant land and, on the other; on the other hand, the lack of competence of the bodies of religious organizations in the specificity of land legal relations with the participation of public authorities. Key words: religious organization, provision of land, property, perpetual use, Rosimushchestvo, cemeteries, appeal of refusal.
