Course Syllabus

Abstract

Academic course “International Intellectual Property Law” is devoted to advanced studies of contemporary matters of theory and practice of Law and Regulation in intellectual property sphere. Intellectual property (IP) plays a significant role in the modern economy, in particular in the digital field. Each country has its own system of intellectual property protection, which includes such basic types of intellectual property rights as utility models and patents (for inventions), trademarks, industrial designs, trade secrets, copyright and related rights. However, a feature of intangible assets is the ease of their distribution, including at the same time the distribution at the international and regional levels, where there are actively developing tools for harmonizing legislation. This process began in the XIX century with the adoption of the first international conventions in this area, and was continued with the creation of the World Intellectual Property Organization (WIPO). The main goal of studying this course by students should be the formation of basic concepts of intellectual property as it is perceived in foreign legislation, as well as an understanding of the main mechanisms of international regulation and knowledge of key aspects. The students will acquire the following skills and abilities: to use specific terms and sources of the global IP Law and Regulation; practical abilities to research and analyze WIPO, WTO, EU and EEU legal documentation and scientific works; skills to analyze and solve cases, building up of the legal position and composition of procedural documents on cases in the sphere of International IP Law and Regulation students must gain knowledge on general standards of IP protection under WIPO, WTO, EU and EEU Law; enforcement of IP rights in the global prospective; drafting international commercial transactions with IP component. Students should gain the following competencies: ability to work with information (search, evaluate, use information, necessary for fulfillment of academic and professional tasks, from various sources, including application of the systematic approach); ability to carry out professional activities in the international environment. The course provides for the active participation of students in seminars and an oral exam. There are no blocking elements of control. The course requires the students to have basic knowledge of law, sufficient level of English (to read legal sources, write essays and participate in class discussions), as well as other skills acquired during their studies at the university. Additional background in civil law, private international law and international procedure is welcome, although not mandatory for the course.

  • The aim of the course is to provide students with a theoretical and practical understanding of the main categories, institutes and sources of International Intellectual Property (IP) Law, including copyright law and related rights, industrial property and trademarks.

  • Students must gain knowledge on: subject and sources of International Intellectual Property (IP) Law; main principles of national law applicable to cross-border commercial transactions with intellectual property rights; international market practice for structuring and documenting cross-border commercial transactions with intellectual property rights
  • Students must gain knowledge on: main provisions, scope of application and content of the market standard legal documentation applicable to commercial transactions with intellectual property rights and the relevant legal concepts and vocabulary; jurisdiction of national courts to resolve disputes arising out of commercial transactions with intellectual property rights
  • Skills and abilities: ability to use specific terms customary in the context of International Intellectual Property (IP) Law; understanding main legal concepts and areas of law applicable to commercial transactions with intellectual property rights; understanding the structure of commercial transactions with intellectual property rights and the main legal documentation (contracts) documenting such transactions
  • Skills and abilities: practical abilities to undertake a research and analysis of judgments, decisions and academic writings; skills to analyze and solve cases, putting together a legal position and compose transactional documents documenting commercial transactions with intellectual property rights
  • Students should gain the following competences: ability to work with information (search, evaluate, use information, necessary for fulfilment of academic and professional tasks, from various sources, including application of the systematic approach); ability to carry out professional activities in the international market environment
  • Students should gain the following competences: ability to search, analyze and work with legally relevant information by using of juridical, comparative and other specific methods; ability to describe legal problems and situations in the area of cross-border commercial transactions with intellectual property rights
