Abstract

The relevance of the course "Intellectual Property and Artificial Intelligence" is determined by development of new technologies and digitalization of the society. Recently, new results of intellectual activity have appeared that do not fall under the concept of a protected IP object in accordance with legislation, new tools for creating results of intellectual activity have emerged and are being developed, raising the question of the “quasi-legal personality” of such entities, as well as the possible recognition of them or their owners as rightholders to objects created with the use of AI. Students will learn to make independent decisions about possible ways to protect intellectual property and the existing risks when bringing a product to the market; will know what opportunities new ways to protect information and IP rights provide, how to collect and use big data to choose a patenting strategy, apply for patents, industrial designs and trademarks. In general, the course aims to improve the legal literacy of students in the field of protection of intellectual property".

  • The objectives of the course are: • explanation of the legal nature, regulation and analysis of legal aspects of the use of artificial intelligence; • familiarizing students with the main theoretical approaches to regulating artificial intelligence;study and analysis of the regulatory framework of Russian and some foreign jurisdictions in the field of regulation of artificial intelligence in relation to intellectual property; • formation of a conceptual apparatus; • familiarizing students with current issues of regulation of artificial intelligence and intellectual property; • developing skills in applying the norms of national legislation and international treaties in practical activities.

  • Basic principles of IP law: - Author / authorship // creation; - Added creation and AI; - Moral rights; - Term of protection; - Exploitation rights; - IP limitation; - Disposal of IP rights. - Deepfakes and IP
  • Legal regulation of AI in IP in foreign legislations (EU, USA, Asian countries).AI lawsuits (DUBUS case; Kashtanova case; Open AI; China case, etc.)
  • Activity of international organization on AI regulation within IP area (WIPO, UNESCO, OECD)
