Course Syllabus
Abstract
International Commercial Arbitration The objective of the International Commercial Arbitration course is to instil in students knowledge about the key sources and institutions with respect to international commercial arbitration processes. Upon completing the course, students should: know: • international regulatory documents, as well as national legislation on international commercial arbitration processes; • key issues in regard to international commercial arbitration processes; know how to: • use acquired knowledge in real-life situations, e.g., taking part in private law dispute resolution in international commercial arbitration; possess: • skills in working with legislation (both international and national), understanding academic literature and analytical materials with respect to international commercial arbitration, and arbitration practice. The International Commercial Arbitration course is based around the following subjects: • Evolution of Conflict of Laws; • Subjects of Private International Law; • Property in Private International Law; • Global Civil Proceedings. In order to master the course, students should possess the following competencies and skills: • understanding fundamental regulatory documentation in international private law, as well as Russia’s civil law; • ability to analyze court/arbitration processes; • ability to work with academic literature, as well as analytical and statistical materials. The key provisions of the course should be used in the future in the study of the following courses: • Settling international commercial and investment disputes; • Corporations under private international law.

Expected Learning Outcomes
- In-depth knowledge of the fundamentals, criteria and principles relating to how international commercial arbitration functions
- Knowledge of key types in the sphere of international commercial arbitration (concepts such as international and ad hoc arbitration); key centres of international commercial arbitration outside of Russia: International Court of Arbitration under the International Chamber of Commerce, The Arbitration Institute of the Stockholm Chamber of Commerce, The London Court of International Arbitration
- Application of relevant legal norms (international conventions and national legislation) to juridical facts within the scope of responsibilities of international commercial arbitration: concepts, scope and types
- Application of special cognition methods for recognizing legally relevant information via analysis and examination in order to secure solutions to real-life case studies
- Application of special cognition methods for recognizing legally relevant information via analysis and examination, as applicable to arbitration agreements as grounds for reviewing disputes in international commercial arbitration
- Definition of juridical facts in relation to laws applicable to arbitration procedures (e.g., the autonomy of the will of the parties in the choice of law for arbitration procedures)
- Definition of juridical facts in relation to laws applicable to international commercial disputes (choice of law by the arbitral tribunal; limits to the determination of the applicable law)
- Definition of juridical facts regarding issues of recognition and enforcing international commercial arbitration awards
- Definition of juridical facts, as applicable to concepts and types of international arbitration agreements
- Definition of juridical facts, as applicable to the procedures for initiating arbitral proceedings; case hearing as a core element of arbitral process; termination of arbitration proceedings, arbitral awards and their contents
- Finding, analyzing and processing legally relevant information
- In-depth knowledge of key concepts, criteria and principles for challenging international commercial arbitration awards
- In-depth knowledge of laws applicable to arbitration agreements (an arbitration agreement as an independent private law contract; options for agreeing upon the rules of law applicable to an arbitration agreement)
- In-depth knowledge of the key concepts regarding the legal status of arbitrators/courts (constitution of arbitral tribunals; general and special criteria for arbitrators; Rules on equity and independence of arbitrators of 2010; grounds and procedures for reviewing challenges against arbitrators)
- Legal expert reviews of documents with respect to international commercial arbitration processes
- The use of special cognitive methods to identify legally relevant information through analysis and examination in order to find solution to real-life cases
- Working with special legal systems (databases)

- Oral exam (online)Экзамен проводится в устной форме (опрос по материалам курса). Экзамен проводится на платформе Zoom (https://zoom.us/). К экзамену необходимо подключиться за 5 (пять) минут до начала, чтобы протестировать работу системы, видео и звука. Компьютер студента должен удовлетворять следующим требованиям: наличие рабочей камеры и микрофона, поддержка Zoom. Для участия в экзамене студент обязан: явиться на экзамен согласно расписанию (подключиться к видеоконференции по предоставленной учебным офисом ссылке), указать свои ФИО при подключении, во время экзамена включить камеру и микрофон. Во время экзамена студентам запрещено выключать камеру и пользоваться ресурсами сети Интернет. Во время экзамена студентам разрешено пользоваться результатами собственной проектной работы, полученными в ходе семинарских занятий. Кратковременным нарушением связи во время экзамена считается нарушение связи менее одной минуты. Долговременным нарушением связи во время экзамена считается нарушение связи (включая, помимо прочего, отключение видео или звука) в течение одной минуты и более. При долговременном нарушении связи студент не может продолжить участие в экзамене. Процедура пересдачи аналогична процедуре сдачи. Пересдача проводится в устной форме.
